摘要：环境执法是环境保护工作的重要手段之一。由于环境执法难，造成环境污染和生态破坏加重，严重制约了经济可持续发展。造成环境执法难的主要原因是：环境立法不完善，环保部门执法能力欠缺，环境执法体制不顺，地方保护主义和企业的环境意识不高。解决环境执法难，必须从完善环境立法，加强环境执法能力建设，理顺环境执法体制，打破地方保护主义，加大对排污企业的监控力度等多方面寻求对策，以保证环境保护工作顺利进度，促进国民经济的可持续发展。

The environment law enforcement is one of the most important methods for environmental protection. It is difficult to enforce the environment law, which aggravates the environmental pollution and ecological destruction and seriouly restricts the sustainable economic development. The primary reasons for enforcing the environment law difficultly are imperfect environment legislation, deficient law enforcement capability of the department of  the environmental protection, unsuitable system of environment law enforcement, regional protectionism and the awareness of environmental protection of enterprises. In order to settle the difficulties of environment law enforcement, we must improve environment legislation, strengthen the capability construction of environment law enforcement, make the system of enforcement execute smoothly, break the regional protectionism, strictly monitor enterprises’ pullution discharge and seek on more countermeasures. These countermeasures can guarantee that the environmental protection works smoothly, and promote the national sustainable economic development.

近年来，我国的环境保护工作取得很大进展，但是随着经济的快速发展，环境压力越来越大，连续几年没有完成污染物减排目标，环境污染和生态破坏已严重制约国民经济和社会发展，这里面固然有多方面的原因，但是环境执法难是其主要原因之一。因此，解决环境执法难问题对促进环境保护工作和国民经济可持续发展具有重大意义。
一、 环境执法难的原因
（一） 环境立法不够完善
现行的环境法律、法规对环境违法行为规定的惩罚力度不够，造成企业“违法成本低”；有一些多发的、常见的环境违法行为存在法律处罚的空洞；有些法律条文在基层执法中无法执行；有些法定处罚幅度过宽，没有量化，配套法规出台滞后，缺乏直接强制执行手段等，最终导致环境执法难。
1、 对环境违法行为的惩罚力度不够。在我国的环境立法中，都有一个最高罚款限额规定，《中华人民共和国大气污染防治法》规定50万元，《中华人民共和国固体废弃物污染环境防治法》和《中华人民共和国水污染防治法实施细则》规定的100万元等，这与有些企业的违法排污行为造成的损失（危害）、获得的利润、治理污染的成本相比简直太少了。如《中华人民共和国大气污染防治法》
