摘要:在主权国家范围内,人们通常把建立秩序与建立政府并通过政府去推行和维护法制关联在一起,但是在国际社会,在人类目前尚达不到建立世界政府的境地,秩序应当如何建立?熊玠在《无政府状态与世界秩序》一书中,提出了自己的思路:他首先对“沃尔兹现实主义理论对国际法在国际社会中作用的虚无主义态度”进行了批判,并且认为“体系价值”是作为与权力平等的要素在国际政治中发挥着作用。笔者与其所持观点的主要分歧在于,至少到目前为止,国际法仍是权力政治的派生物,而不具有与后者平等的地位。
　　Abstract: Order within soverEign states is often related with the government and the legal system it creates, but how can order be kept in the international community without a world government? In his book , Professor Xiong Jie put forward his ideas. He criticized Kenneth N.Waltz’s Structural Realism, which takes a negative attitude on the role of international law, arguing that “system value” plays the role of the same significance as power does in international politics. Personally, I think international law is still the derivatives of power politics, which is more important.
