试论住宅小区物业管理关系设立的法律依据 |

摘 要: 本文的目的是:从民法理论中所有权概念的角度分析当前住宅小区物业管理关系建立的法律依据,概述部分主要是阐述“物业管理”概念和当前物业管理市场中存在的突出矛盾。第一部分主要是对我国物业管理法规的立法历史回顾,介绍和分析了我国物业立法的过程和特殊背景。第二部分是沿着我国的住宅市场发展的轨迹,平行比较了在不同历史时期对不同属性的住宅进行管理所依据的不同法规,揭示法规的演进过程和物业管理关系形成的原因。第三部分是以民法理论中的所有权概念为工具试图分析当前我国物业管理关系形成的法律依据的脆弱性,并以航空法为参照做了适量的类比分析。第四部分是结论部分,主要是提出了作者对物业管理关系的个人理解。结束语部分是作者对我国物业管理立法的个人建议。 关键词: 物业,业主,物业管理,建设部第5号令,建设部第19号令,建设部第33号令,所有权 abstract : the objective of this essay is to analyze legal foundation property management of residence compounds at the time being from the concept of ownership of civil law theory.the general introduction mainly describes the concept of property management and the outstanding conflicts in the existing laws and regulationgs of p.m.in our country.the first part of the body looks back the history of the establishment of p.m. lans & regulations,analyzes and introduces the process and the spcial background of such establishment.part two parallel compares different l&r to properties of different nature during different times by tracking the housing market development in our country,and discloses evolution of l&r and the reason to constitution of relationships in p.m. the third part intends to analyze the weaknesses of foundation of l&r of p.m.relationships by utilizing the concept of ownership of civil law as a tool,and makes proper analysis based on aviation law.the fourth part is a conclusion that mainly propose the writer’s personal understanding on p.m.relationships.the essay ends with the writer’s individual suggestion on p.m.lawmaking in
